Rules and Guidelines
Eligibility
The Sebago Lake Distillery Cocktail Competition (“Competition”) is open to legal residents of Maine, age 21 or older at the time of entry. Employees of Sebago Lake Distillery are not eligible to participate. Participation is subject to all applicable Federal, state and local laws and regulations. Professional Bartenders Only: All participants must be currently employed by a business that is licensed to sell alcoholic beverages in Maine. Additional eligibility criteria are below.
Competition Period
The Sebago Lake Distillery Cocktail Competition will begin on November 1st, 2018 at 12:00 a.m. Eastern Time and end on November 30th, 2018 at 12:00 a.m. Eastern Time (ET).
To Enter
During the Competition Period, entrants to the competition (“entrants” or “you”) must visit the Sebago Lake Distillery website and follow the instructions provided. You will be prompted to complete an entry form by providing your first and last name and email address. After you complete the entry information, include your cocktail recipe title and a full and complete list of all ingredients and exact preparation instructions, and upload a photo or video of your entry. Only entries with a complete list of ingredients (all measurements specified) and complete preparations will be considered “Valid Entries.” Only entries received during the Competition Period and which are otherwise fully compliant with these Official Rules are “Valid Entries.” All Valid Entries will be eligible for the Posting Period immediately following submission.
You may make unlimited entries per person during the Competition Period, only using one email address during the Competition Period. In the event of a dispute involving entries submitted by multiple individuals using the same email account or address, the entry will be deemed to have been submitted by the authorized subscriber of the email account used to enter the competition at the time of entry.
All entries will be reviewed for content and must be in compliance with these Official Rules. Entries that do not comply as determined by the Sponsors will be disqualified. The Sponsors in their sole discretion will make the final determination which entries are deemed Valid Entries and eligible for participation in the Competition and to be considered for posting and prizes.
Posting Period
During the Competition Period, Finalist winners will be chosen by public vote in six (6) categories on the Sebago Lake Distillery website from all submitted entries. There will be one (1) winner each in the following six (6) categories: Recipe and photo for Sebago Lake Original Rum; Recipe and video for Sebago Lake Original Rum; Recipe and photo for Sebago Lake KOPI Coffee Flavored Rum; Recipe and video for Sebago Lake KOPI Coffee Flavored Rum; Recipe and photo for Sebago Lake Spider Island Rum; Recipe and video for Sebago Lake Spider Island Rum. See Finalist Notification for regulations. Potential winners will be required to participate in a brief interview via email. Failure to comply with requirements may result in potential Finalist being replaced by potential runner up.
Judging Rules
During the Competition Period, votes will be cast online by the general public at the Sebago Lake Distillery website, www.sebagolakedistillery.com. Each recipe must feature one Sebago Lake Distillery product. An entrant may win more than one Finalist Prize. Finalist entrees will be posted on the Sebago Lake Distillery website and will become eligible to participate in the Sebago Lake Distillery Cocktail Showdown.
Finalist Notification
Potential Finalists will be notified via email using the information provided on their entries. In order to be eligible for the Grand Prize, Finalists must respond to the notification and confirm their full name, address, city, state, zip code and daytime phone number within three (3) days of initial notification, or a runner up Finalist may be selected, at discretion of Sponsor. Email notification shall be deemed to have occurred on the date Sponsor or Sponsor’s designee first attempts to make email contact with potential finalist. Sponsor is not responsible for unsuccessful efforts to notify potential Finalist.
Finalist Prizes
A check in the amount of $250 will be awarded to the Finalist in each of the six (6) cocktail categories. Finalists will be eligible to win the $500 Grand Prize.
Grand Prize Determination
At the end of the Competition Period, Finalists will be required to attend the Sebago Lake Distillery Cocktail Showdown, held at a place and time to be determined by Sebago Lake Distillery. Finalists will mix and share their cocktails with a panel of judges selected by Sebago Lake Distillery.
Grand Prize
At the Sebago Lake Distillery Cocktail Showdown event, one (1) winner from amongst the Finalists will be selected to be the Grand Prize winner. A check in the amount of $500 will be presented to the Grand Prize winner. All six (6) cocktails will be posted on the website within the following weeks at the end of the Competition. All six (6) Finalists will be subject to further interviews and will be featured by Sebago Lake Distillery.

Intellectual Property and Publicity Release
By completing an entry form and/or submitting any recipes, cocktail names, preparation notes, any other written materials, photographs or video recordings (all of the foregoing, “Your Content”) to Sebago Lake Distillery through the website, or by undertaking any other steps to participate in the contest, you hereby:
- Represent and warrant that Your Content does not violate the law or any intellectual property rights or any other rights of any third party, and that you have secured any third-party consents or authorizations necessary to make that representation and warranty (including the permission of any individuals or establishments portrayed in Your Content);
- Grant Sebago Lake Distillery a permanent, irrevocable, royalty-free, fully paid up, worldwide license (with the right to sublicense same, without your separate notice, consent or compensation) to use, modify and display Your Content in any way that Sebago Lake Distillery deems appropriate, including but not limited to displaying your name, likeness, voice and any biographical information that you may submit to us in promotional materials.
LIABILITY WAIVER
YOU HEREBY (A) ASSUME FULL RESPONSIBILITY FOR ANY RISK OF BODILY INJURY, DEATH, PROPERTY DAMAGE, BUSINESS LOSSES OR OTHER INJURIES, DAMAGES OR LOSSES, AND ANY CLAIMS OR DEMANDS THEREFOR, WHETHER PERSONAL, ECONOMIC OR OTHERWISE IN NATURE, RELATING TO THE COMPETION AND YOUR PARTICIPATION IN IT, WHETHER CAUSED BY THE NEGLIGENCE OF SEBAGO LAKE DISTILLERY AND ITS EMPLOYEES, OFFICERS, DIRECTORS, AGENTS AND SUCCESSORS (COLLECTIVELY, “RELEASEES”) OR OTHERWISE, AND (B) RELEASE, WAIVE AND DISCHARGE ANY AND ALL CLAIMS OR CAUSES OF ACTION YOU MAY HAVE AGAINST ANY RELEASEE, AND AGAINST FACEBOOK, INSTAGRAM AND ANY OTHER OPERATOR OF ANY ADVERTISING SERVICE THAT SEBAGO LAKE DISTILLERY MAY USE TO PROMOTE THE COMPETITION, RELATING TO THE COMPETITION OR TO THIS AGREEMENT.
INDEMNIFICATION
YOU WILL INDEMNIFY AND HOLD HARMLESS SEBAGO LAKE DISTILLERY AND ITS EMPLOYEES, OFFICERS, DIRECTORS, AGENTS AND SUCCESSORS (COLLECTIVELY, “SLD INDEMNITEES”) FROM AND AGAINST ANY THIRD PARTY CLAIMS, DEMANDS, ACTIONS AND PROCEEDINGS, AND ANY RESULTING LIABILITIES, DAMAGES, COSTS AND EXPENSES (INCLUDING LEGAL FEES AND EXPENSES), BROUGHT AGAINST ANY SLD INDEMNITEES, ARISING FROM OR RELATING TO (A) YOUR PARTICIPATION IN THE COMPETITION AND (B) YOUR CONTENT.
Additional Information
The odds of your becoming either a Finalist or the Grand Prize winner depend on the number of total participants. If you are a Finalist or the Grand Prize Winner, you may be required to execute an affidavit confirming your eligibility and compliance with these rules. Prizes won in the Competition are not transferable. Winners are liable for paying any taxes associated with the prizes. The Competition is not sponsored, endorsed or administered by, or associated with, Facebook, Instagram or any other operator of any advertising service that Sebago Lake Distillery may use to promote the Competition.
Sebago Lake Distillery reserves the right to cancel, postpone or modify the terms or rules of this Competition at any time before or after you submit your entry. And dispute between you and Sebago Lake Distillery regarding these rules or the Competition will be governed by Maine law and adjudicated in Maine by mediation. These rules are void where prohibited by law.
